Not that I’m an expert, but anyone can release an album with someone else’s music as long as it has been previously released by the original artist. Once it’s out there ANYONE can re-record it, put it on an album and sell it. If the artits’ (you can use that tern loosely when it comes to Scarlett) didn’t come to some payment arrangement beforehand, there is a compulsary license – usually something like $.10 per unit sale or something. It’s in copyright law. This way the original artist is guaranteed something should the cover artist make some $. How else do you think Sweet Dreams, It’s My Life, and all those other crappy covers get out there…. do you really think the artists are giving permission for that stuff????

Thanks G-Man for the info! But, doesn’t the Label or the person who owns the publishing rights still have the final say on whether someone can license it and use it in a crappy commercial? The Beatles held out for a while? Maybe, that has changed. I guess I just held out hope that if you put out a great song and retain the rights, you can protect it against Puff Daddy using it as a bed in his so-called music. Ugh… I’m going to listen to my Kidz Bop CDs now…
